From the Sunday July 31, 2011 Observer Dispatch Legal Notices:

PLEASE TAKE NOTICE, that pursuant to Section 21-2100 of the Village Law of the State of New York, the Village Law of the Village of New Hartford, New York and Article 13-D of the General Municipal Law of the State of New York, the Village Board of the Village of New Hartford, New York will hold a public hearing on August 8, 2011 at 7:30 pm at Butler Memorial Hall, 48 Genesee St., New Hartford, regarding the application of The Sunset Home of Utica ("Sunset") regarding its premises and improvements located in the Village of New Hartford, commonly known as The Community at Sunset Wood ("Project") for designation under Section 290 of the General Municipal Law as a community facility with programs for the elderly, with Sunset as operator thereof.

The application further requests that the Village of New Hartford assist Sunset to defease all tax exempt bonds currently outstanding concerning the FHA-insured Mortgage Loan for the Project, to thereby accept title to the Project and lease the Project to The Sunset Home of Utica on a non-recourse basis in connection with a proposed FHA insured refinancing of the Project.

Wow. Had to go to the dictionary to figure that one out. Defease - to defeat or annul (a contract, deed, etc.).

They want their outstanding debts annulled and the village to back new debt by taking ownership of the business - but let the current managers continue to operate the business with no way to change who manages it? Is that right?

Wow something SMELLS Here sounds like the Town V/S Adler!Yeager getting the Village tax payers to foot their bills! When will it END?

Actually, this has nothing to do with Adler or Yager.

This is regarding Sunset Wood, the senior housing complex near the New Hartford Shopping Center.

Is there an advantage to the Village to be involved? Why would the Village want to take ownership? Is this another project like the building they bought for over $200,000, tore down, and are now left with a dirt pile.

The only advantage we see is for Sunset Woods.

Could it be that their current PILOT is about to expire? If so...they would remain tax exempt if they were to be owned by the village. It sounds sort of like a PILOT by Oneida County IDA except that the village is involved as the owner with a lease back to Sunset.

We don't have any more information than was published in the legal notice.

Village residents should be asking some questions. Actually so should town residents.

Everyone is suppose to show up for this Public Hearing??? What good did it do us to show up for the Public Hearing on our taxes going up. People have to show up at the next election for the Board....this Board looks and sounds like it is useless and they r going to do as THEY want. We need a fresh start from the TOP down,a Board that will defend the tax payers!!!! Thanks for the information anyway...at least we will know what to expect!

Don't forget that the btown board and supervisor are the smartest people in the town. They know so much more than you ordinary Joes . Don't you notice that the lights in your house grow dimmer when the board is meeting? They know what is best for us ,just try to imagine the brain power in that room.
