Eminent Domain...

A town board meeting was held last night.

Everyone has probably already read about the 15% contribution for the Dispatch health care benefits that were not collected by the town, Tyksinki: Reed failed to collect health care benefits.

Was it Reed's job to see that the 15% health care contributions were collected...what about the person doing payroll? Or did Reed gave a directive to the person that was doing the payroll?

Anyway, another topic not reported on in today's paper was eminent domain - the taking of private property for a public use. After a rather lengthy Executive Session, the board voted unanimously to initiate eminent domain proceedings against the Yagers (Twin Orchards) for the property that Larry Adler "needs" so that the business park can "flourish".

My, oh my, the things a "progressive" town like New Hartford has to do to keep the developers happy!

Be sure to read what Strikeslip has to say on this topic...Taking and Giving in New Hartford...!

UPDATE: The Observer Dispatch now has an article online...Town to use eminent domain to gain access to business park.

When was the public hearing about this? Since the Town board is acting on on the public's behalf when was the public hearing on this? I don't remember any announcement in the paper. If the town can do this to the Yagers they can do this to anyone. Don Blackman is such a dissapointment. He talked a big game before he was elected but has he ever taken a public stand against the town board? Why does Don say they is no other way? There is always a choice Don.

The Town Board in executive, i.e. secret, session voted to seize priviate property from the Yagers and give it to a out of town developer, Larry Yager for his business park. If the town can do this to the Yagers, they can do this to anyone. Worst of all, Councilman Don Blackman, the man elected as a reformer, has joined right in with the pilliaging.

This is the most outrageous use of government power I have ever heard of. How dare they feel they can just take the land of a property owner for the good of a developer.

First just to clarify...they did not vote in secret; they only discussed the subject in executive session. The vote was taken in public and videotaped.

And yes, if they can do it to one New Hartford resident, they can do it to anyone in New Hartford...and they just proved that they have no problem doing it!

Does Larry Adler have photos that he is going to use if the town board doesn't see things his way? This town board just doesn't get it WE ARE FED UP with their spending and disregard for the electorate.
P.S. why no comments about the 130000 to install another traffic signal on STATE rte.5. Let the state pay its their road.

I oppose this modification of the emanate domain law in which allows for public tax dollars to be funneled into private hands. Legal or not, this emanates a foul odor of impropriety. How is it, when the Town of New Hartford’s public officials think that, perhaps the public is not paying close attention to their Town finances, that corruption rears its ugly head?

Follow the money trail as taxpayer funds will be again blaze a path to prosper the private owner of the New Hartford Business Park. This begs the question as to how this private owner will use his savvy to weave a complex path in an effort to reciprocate for his public benefactor’s generosity. One can’t help but wonder if the Town officials would be so generous, in terms of giving away taxpayer money to this owner, if the Business Park were to be called “Adler Acres?”

What's interesting is that Concerned Citizens broke this story a day before the OD did! It looks like OD reporter Brauchle is again failing to report negative information on New Hartford. I think the only reason the OD finally reported it was because the CC did. Good job Cathy and Ed. BTW, did you see the title of Bob Brauchle's new blog: "An Insider's look at Oneida Count." What a joke! A reporter should not be an "Insider." The fact that he would even claim to be one shows he is too close the subject he is supposed to be covering. Brauchle seems more interested in protecting the reputation of Pat Tyskinski, Herb Cully, ect.

WARNING: the OD is now deleting any comments on its online site that are critical od the paper and critical of the Town of New Hartford Board. Several posts have disappeared under the articles for the Eminent Domain and the article on the town collecting the insurance premiums.

Wow! The OD is acting more like "Provda" every day. What a shame.

Here is one example that the OD removed from their site:

I have no doubt that what we are seeing is a systematic failure all around the OD. Why? Is it because the OD believes that they need to be a regional cheerleader? Is it because they are trying to protect certain groups or people? Is it because financial constraints limit the OD's ability to hire and retain high quality staff? Is it just the complacency that comes from being the only printed news source in town? Is it a combination of all of them? I don't know... but I do know that in the day of the internet and new media no paper can long hide its shortcomings.

And now that the disgrace is requiring real names and addresses, they can harass those critical of them and their friends. You can join the rest of us. My brother was in a car accident where the other car was clearly at fault and the cop left out all the skid mark evidence and other evidence when he learned I was his brother.
