After almost a week battling the flu, I'm back and my desk looks like a cyclone came through. Must be I need more office space--I'm "outgrowing" my present location.
Any rate, let me start by listing important dates:
February 12 - 7 p.m. Room 27 of the Career & Technical Education Center - Public hearing on BOCES bonding plan
February 13 - Noon - 8 p.m. VOTE for BOCES bonding plan at your respective school district
February 15 - According to a Monday, February 5th Observer Dispatch article, Town, county & School officials plan to meet before this date to resolve the Preswick Glen issue. Once again, the town board went into executive session after the February 7 Town Board meeting to discuss Preswick Glen. So does that mean that the exemption has already been filed? Until Preswick Glen files for an exemption, the question as to whether or not they are exempt really can't be answered.
The Observer Dispatch doesn't seem to get this one point correct. In the Observer Dispatch article on Monday February 5, 2007, it was reported that "In 2001, a previous New Hartford town board entered into a municipal services agreement with the Preswick Glen developers, exempting the 40-acre Clinton Road project from property taxes." That is simply not true! Until such a time as Preswick Glen files for an exemption, they will be assessed for the market value of the portion of the project that is complete--period. The MSA does not automatically give them a tax exemption. In order for Preswick Glen to get tax exempt status, the assessor has to agree that their exemption application entitles them to the exemption. Our guess is that will be a decision made by the assessor in consultation with the town board and there is no reason why it shouldn't be made shortly after March 1 (Taxable Status Date) at the latest. The decision clearly should be available to residents prior to the March 29, 2007 bond vote! Incidentally, the most recent MSA signed between the town and Preswick Glen is dated March 2004.
